For companies building or deploying AI models, the exposure scales with the consequence of the decision the model makes. They want to know whether you’re fine-tuning or using models as-is, because fine-tuning changes the liability profile. Insurers will ask to see sample customer contracts to understand what you’ve warranted about model performance, what disclaimers you’ve included, what liability caps you’ve negotiated, and whether you’ve accepted indemnity obligations for model failures. If you’re warranting 99% accuracy without qualification, accepting unlimited liability for model errors, or indemnifying customers for all losses arising from model outputs, you’ve created exposures that may exceed available insurance capacity. Insurers want to see that your contract terms are realistic relative to what the model can actually deliver and that you’ve capped liability at insurable levels.
Not all model risk is insurable.
